To retract your express consent from Wyndham Destinations Asia Pacific contact Lifestyle Solutions Customer Service on 1800 603 686 or +61 7 5512 8040, and verbally request your retraction when speaking with a company representative at time of call. Alternatively you are able to email your retraction by emailing firstname.lastname@example.org.
12. Use of Personal Information
12.1. Upon activation of your Lifestyle Solutions by WorldMark membership, you agree that we may store, process and use the information collected during your registration process for the purposes of processing your activation, promoting the Lifestyle Solutions by WorldMark Program and/or offering you products on or related to Lifestyle Solutions by WorldMark benefits.
13.1. You cannot and will not assign any rights and obligations under these Terms whether in whole or in part without the prior written consent of Wyndham.
13.2. If any part of these Terms are held to be invalid or unenforceable in whole or in part by a relevant governing or legal body the validity of the remaining parts of the Terms and Conditions shall not be affected.
13.3. Neither our failure or delay nor your failure or delay to exercise any Term contained in this document will constitute a waiver of such Term. None of Wyndham‘s employees, affiliates or agents has the authority to vary any of the Terms contained herein.
13.4. The Terms and access to the Lifestyle program are governed by and will be construed in accordance with the laws of the State of Queensland Australia irrespective of where the application for activation has been completed by the Lifestyle Solutions by WorldMark member or submitted to Wyndham. In any action or other legal process with respect to any matter or thing in connection with these Terms or the parties submit to the non-exclusive jurisdiction of the State of Queensland.
13.5. The Lifestyle program is offered to those who are 18 years and over. By using our website to access the Lifestyle program, you are confirming that you are 18 years or over.
14. Force Majeure
Wyndham shall not be held liable for any delay in performing any obligations under these Terms and Conditions to the extent that such delay is caused by circumstances beyond Wyndham’s reasonable control. In such circumstances where delay is caused due to no fault of Wyndham, Wyndham will be entitled to a reasonable extension of time for the performance of such obligations.
15. Lifestyle Solutions by WorldMark program
15.1. Lifestyle Solutions by WorldMark is a member benefit program offered by Wyndham, which may be terminated by Wyndham at its sole discretion, and does not and is not intended to fall within the ambit of AFS Licence No. 225200 held by Wyndham Vacation Resorts South Pacific Ltd ACN 090 503 923.
15.2. No costs associated with Lifestyle Solutions by WorldMark are passed on to the WorldMark South Pacific Club.
15.3. Participation in the Lifestyle program is separate from Ownership in WorldMark South Pacific Club and can be modified or discontinued at any time.
16.1. We accept payment by Credit Card only via a payment gateway, excluding PayPal, for item purchased on the Lifestyle Solutions by WorldMark website.
17. Lifestyle Vouchers/eGift Cards
17.1 Lifestyle eGift Cards are digital and sent electronically via email. Lifestyle does not issue physical gift cards.
17.2 The eGift Card denominations are $50, $100, $150, $200, and $500.
17.3 Follow the procedures set out on the Website when ordering. You have the choice to:
a. Email the eGift Card to yourself. Each time you buy an eGift Card, it will be stored in your Lifestyle account, “My Wallet”. You will be able to see it added to your Store Credit.
b. Email the eGift Card as a gift and provide a personal message.
b.1. Each time you send a Lifestyle eGift Card to a friend you, will be notified through email when your friend has opened the card with voucher code.
The Lifestyle eGift Card can be used by members only. If the eGift Card is received as a gift, the recipient must sign up to Lifestyle to be able to use the eGift Card.
Recipient must follow the redeeming procedure - login to Lifestyle, access “My Gift Cards” to apply the voucher code at checkout.
You cannot use the Lifestyle eGift Card unless you are a Lifestyle member.
b.2. Once the eGift Card has been opened, Lifestyle no longer accepts responsibility of the eGift Card.
b.3. If your friend has not received their email notifying them of their eGift Card, ask your friend to check their junk mail.
b4. In the event the email you have chosen is incorrect, please contact 1800 603 686 so we can review your request and re-direct to the correct email. When sending to a friend, you are required to type in the email address a second time to reduce the risk of sending it to an incorrect email. If by accident you have selected the wrong email, and the eGift Card has already been opened, we are unable to assist with this request.
17.4 If we find inappropriate, offensive or otherwise objectionable messages or images, we reserve the right to remove the offending message and apply a default message. Offending material includes, but is not limited to:
a. Patently offensive material that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b. Copyrighted or trademarked material not owned by you;
c. Abusive, threatening, obscene, defamatory or libellous statements;
d. and Political, religious, offensive to cultural values.
By redeeming a Lifestyle Voucher/eGift Card, you agree to the following terms.
17.5 eGift Cards are redeemable on our website or app. To redeem this, you must login to Lifestyle, access My Gift Cards to apply the voucher at checkout.
17.6 eGift Cards are immediately activated, and valid for use within 36 months from the date of issue.
17.7 eGift Cards are non-refundable. eGift Cards may not be redeemed or exchanged for cash, traveller’s cheques, cash passports or any other form of currency.
17.8 eGift Cards can be combined with credit card to purchase in Lifestyle.
17.9 Lifestyle may cancel any invalid eGift Card (including any available balance) which Lifestyle determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means.
Lifestyle may cancel any bookings made using any fraudulent eGift Card which may include any non-refundable amounts. Lifestyle will not be responsible for any costs incurred by you if you purchase or attempt to redeem any fraudulent eGift Card.
You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent eGift Card and that Lifestyle will not be obliged to hold such balance on file for you or otherwise redeem or exchange that eGift Card.
